Distance Sales Agreement

This Distance Sales Agreement ("Agreement") is entered into electronically between the Seller identified below and the Buyer who places an order through LUSSOIE.com.

BUYER
The Buyer's name, surname, billing and delivery address, telephone number, email address and other order information shall consist of the information provided electronically by the Buyer during the ordering process.
2. Subject of the Agreement
The purpose of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product(s) ordered electronically by the Buyer through LUSSOIE.com.
This Agreement is governed by Turkish Consumer Protection Law No. 6502, the Regulation on Distance Contracts, and other applicable legislation.
3. Product and Order Information
The following information relating to the product(s) ordered by the Buyer shall be displayed to the Buyer before the order is completed:
- Name and essential characteristics of the product
- Quantity
- Sale price including applicable taxes
- Any applicable discounts
- Shipping or delivery charges, where applicable
- Payment method
- Total amount payable
The electronic order summary and payment information relating to the relevant order form an integral part of this Agreement.
4. Payment
The Buyer shall pay the total order amount using one of the payment methods made available on the website.
Card payments may be processed securely through an authorised payment service provider contracted by LUSSOIE.
If payment cannot be completed or is cancelled or declined by the relevant bank or payment service provider, the order shall not be considered successfully completed.
5. Delivery
The order shall be delivered to the delivery address provided by the Buyer during checkout.
The Seller shall deliver the product within the delivery period communicated to the Buyer and, in all cases, within the maximum period required by applicable legislation.
If performance or delivery becomes impossible, the Buyer shall be informed in accordance with applicable law and any amounts collected shall be refunded in accordance with the applicable legislation.
The mere fact that a product is out of stock shall not, by itself, constitute impossibility of performance.
The Seller shall remain responsible, to the extent required by applicable law, for loss or damage occurring during transportation until the product is delivered to the Buyer or a third party designated by the Buyer.
6. Right of Withdrawal
Subject to the exceptions provided by applicable law, the Buyer has the right to withdraw from this Agreement within 14 days from the date on which the Buyer or a third party designated by the Buyer receives the product, without giving any reason and without incurring a penalty.
The Buyer may also exercise the right of withdrawal before delivery of the product.
To exercise this right, the Buyer must send the Seller a clear statement of withdrawal within the 14-day period through one of the following channels:

7. Return of Products
Where the right of withdrawal is validly exercised, the Buyer must return the relevant product to the Seller or a person authorised by the Seller within the period prescribed by applicable law following the withdrawal notification.
The applicable return shipping method and conditions are specified in the Pre-Information Form and the LUSSOIE Returns & Shipping Policy.
Where reasonably possible, products should be returned with their original packaging and any components supplied with the product.
This requirement shall not be interpreted or applied in a manner that unlawfully restricts the Buyer's statutory right of withdrawal.
8. Refunds
Where the right of withdrawal has been validly exercised, refunds shall be made within the periods and under the conditions prescribed by applicable law.
Refunds shall be made using a payment method consistent with the payment method used for the original purchase and without imposing additional costs on the consumer, unless otherwise permitted by applicable law.
The time required for a refund to appear in the Buyer's bank or card account may depend on the processing times of the relevant bank or payment service provider and may be outside the Seller's direct control.
9. Exceptions to the Right of Withdrawal
The right of withdrawal may not be exercised in circumstances excluded under the applicable Regulation on Distance Contracts.
In particular, where permitted by applicable law, the right of withdrawal may not apply to goods which are unsuitable for return for health protection or hygiene reasons where their protective packaging, wrapping, seal, tape or other protective element has been opened after delivery.
Accordingly, for LUSSOIE products intended to come into direct contact with the skin, the applicability of this hygiene exception will depend on the nature of the relevant product and whether its hygiene seal or protective packaging has been opened after delivery.
This exception does not limit or remove the Buyer's statutory rights in relation to defective, damaged or non-conforming products.
10. Defective or Non-Conforming Products
If a product is delivered defective, damaged, incomplete or otherwise not in conformity with the order or contract, the Buyer retains all statutory rights available under Turkish Consumer Protection Law No. 6502 and other applicable legislation.

11. Force Majeure
Where performance of the Agreement is affected by circumstances beyond the reasonable control of the parties, including natural disasters, war, epidemics, strikes, serious transportation or communication disruptions, decisions of public authorities or similar events, the relevant provisions of applicable law shall apply.
12. Personal Data
The Buyer's personal data may be processed for purposes including order processing, payment, delivery, customer service, returns and compliance with legal obligations, in accordance with applicable personal data protection legislation.

13. Dispute Resolution
Consumers may apply to the competent Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or Consumer Courts (Tüketici Mahkemeleri) in accordance with the monetary thresholds, jurisdictional rules and procedures applicable at the relevant time.
Nothing in this Agreement restricts the consumer's rights to seek remedies available under applicable consumer protection legislation.
14. Entry into Force
Before completing the order, the Buyer shall be given the opportunity to review the Pre-Information Form and this Distance Sales Agreement electronically.
The Buyer acknowledges that placing the final order creates an obligation to pay.
This Agreement is concluded electronically when the Buyer confirms and submits the order.
